I reprocessed your new grayscale.eps and it is still the same as before If you want to accept some small mean value as a threshold for all CMY channels that is close enough to 0 for you, then you could consider those as (essentially) gray. You misunderstand somewhere. If there is channel K, it is CMYK, no matter what the values are.

I do not believe you have a proper RGB image. It has CMYK channels. Nevertheless, if all your images have CMYK channels, then you can tell if gray and not color, if only the K channel has non-zero mean in the statistics and the mean of CMY channels equals 0.
